General conditions for excursions

  1. GENERAL TERMS AND CONDITIONS OF EXCURSIONS

    These General Terms and Conditions govern the mutual relations between PRIMOSTEN EXCURSIONS, represented by Trogir Travel Agency, Gradska 26, Trogir, and Fulmar d.o.o. for Tourism, Obala Dr. Nikole Lozovine 12, Seget Donji, Croatia, ID HR-AB-21-060326472 (hereinafter referred to as the “Agency”), and a passenger or tour operator when a tour operator enters into a contract for the benefit of a third party as a passenger (hereinafter referred to as the “Traveler”) in connection with the organization of an excursion or trip.

    The tour organizer is clearly indicated on the Certificate of Trip Purchase (voucher, card, or invoice) as the responsible organizer.
    If the organizer or service provider is different from the Agency, the Agency acts solely as an authorized intermediary.


    1. Booking and Payment

    By paying the excursion price and providing the required personal information to the Agency (in person, by phone, fax, email, post, or online), the Traveler concludes an Excursion Contract consisting of:

    • the Excursion Certificate (voucher/invoice),

    • the excursion program, and

    • these General Terms and Conditions.

    If not otherwise specified in the program, the Traveler must pay the full excursion price at least 24 hours before departure.


    2. Excursion Content

    The price of the excursion includes only the services specified in the excursion program.
    Additional services (transfers, meals, tickets, tips, etc.) not listed in the program may be provided by the Agency and must be paid for separately by the Traveler.

    If any service requested by the Traveler is not included in the program, the Agency will inform the Traveler of its cost before the conclusion of the contract.

    The Agency bears no responsibility for services purchased directly from third parties or arranged during the trip with local providers.


    3. Service Categorization

    All services (restaurants, transport, accommodation, etc.) are described according to the official local categorization at the time of publication.
    Standards of comfort, food, and services may vary between destinations and cannot be directly compared.

    The Agency is not responsible for verbal or written information inconsistent with the official excursion description or these Terms and Conditions, received from unauthorized third parties.


    4. Promotional Material and Notices

    The Agency is not liable for typographical or printing errors in brochures or for later changes after publication.
    All information and notifications provided to the Traveler before booking form part of the contract only if expressly included in the excursion program.


    5. Itinerary and Schedule

    The itinerary binds both the Agency and the Traveler.
    The Traveler must follow instructions given by the Agency’s representative, escort, or guide.

    If a Traveler separates from the group before receiving information on the time and place of rejoining, any resulting costs or damages cannot be charged to the Agency.
    Failure to appear on time at departure or continuation points will be considered a cancellation by the Traveler.

    The Agency shall not be liable for changes caused by weather conditions or other natural events that prevent realization of the program or alter the order and duration of activities.


    6. Prices

    Excursion prices are listed in the official program and valid from the date of publication.
    The Agency reserves the right to increase prices up to 7 days before departure in case of:

    • changes in taxes or exchange rates,

    • increases in transport or fuel costs, or

    • increased fees (airports, ports, etc.) affecting the excursion price.

    In case of fewer participants than the minimum required, the Agency may change the price or cancel the excursion, refunding all amounts paid.

    If the price increase exceeds 10%, the Traveler has the right to cancel the contract and receive a full refund, without compensation for insurance or visa costs.


    7. Changes and Cancellations

    The Agency will promptly notify the Traveler of any program changes.
    The Agency may cancel or modify the excursion before or during the trip due to force majeure (war, unrest, strike, terrorism, natural disasters, traffic disruptions, or similar events beyond its control).

    The Agency may:

    • change departure time or route, or

    • cancel the excursion if the minimum number of participants is not reached.

    In such cases, the Traveler is entitled to a full refund but not to additional compensation.

    If the Traveler refuses a proposed alternative excursion, the contract is terminated, and the Traveler will receive a refund of payments made.


    8. Payment Terms and Cancellation Policy

    Deposit:
    A 30% non-refundable deposit is required upon booking confirmation to secure a reservation.
    The price is guaranteed only once full payment is received and travel documents are issued.

    Final Payment:
    Due 21 days before arrival, unless otherwise stated.

    Cancellations by the Traveler:
    All cancellations must be made in writing to Trogir Travel Agency.
    Cancellation fees are applied as follows:

    • 0–7 days before departure: deposit and balance retained (100% charge)

    • 7–14 days before departure: deposit retained, 50% of balance refunded

    • 14–21 days or more before departure: deposit retained, balance refunded in full


    9. Traveler Responsibilities

    The Traveler must hold valid travel documents and comply with customs, health, and border regulations of Croatia and destination countries.

    The Agency is not responsible for:

    • denial of entry by authorities,

    • refusal to issue a visa, or

    • costs incurred from such events.

    The Traveler must follow the itinerary, respect accommodation and transport rules, and cooperate with Agency representatives.
    The Traveler bears full responsibility for personal safety, behavior, and belongings.

    Loss or theft of documents or property during the excursion is the Traveler’s responsibility.


    10. Passenger Replacement

    If unable to travel, the Traveler may designate a replacement traveler who meets all travel conditions.
    The Agency must be notified in writing in due time and will charge any administrative or rebooking costs caused by the replacement.


    11. Luggage

    The Agency is not responsible for the transport, loss, or theft of luggage or valuables.
    Claims for lost or damaged luggage must be made directly to the carrier or accommodation provider.

    Special luggage (e.g. sports equipment, instruments) must be announced in advance and may incur additional charges.
    The carrier may refuse oversized items due to capacity limits.
    Pets are generally not allowed, except upon prior request and with possible surcharge.


    12. Complaints

    If the Traveler identifies a service irregularity, they must immediately inform the service provider and the Agency representative to allow correction on the spot.

    If the issue cannot be resolved, a written confirmation must be obtained from the service provider.
    Upon return, the Traveler may submit a written complaint within 8 days to the Agency where the excursion was purchased.

    The Agency will respond within 15 days, and may extend this period by another 15 days for verification.
    Until a response is issued (maximum 30 days), the Traveler shall not initiate proceedings before other institutions or the media.

    Compensation for justified complaints shall not exceed the unused portion of the excursion price.

    Group complaints and those filed after the deadline will not be considered.


    13. Excursions Organized by Other Agencies

    If the excursion is organized by another tour operator, the terms and conditions of that organizer apply.
    In such cases, the Agency acts only as an intermediary and assumes no responsibility for the performance of services.


    14. Final Provisions

    These General Terms supersede all previous editions.
    Any deviations must be stated in the specific excursion program.

    By booking an excursion, the Traveler:

    • confirms that, if a parent of a minor, the other parent is informed and consents to the contract,

    • voluntarily provides personal data for the purpose of contract fulfillment and communication,

    • acknowledges that travel insurance options (accident, baggage, cancellation, health) were offered and recommended.

    If the Traveler wishes, insurance can be arranged through the Agency or directly with an insurer.

    All disputes shall be resolved amicably; otherwise, the Court in Trogir, Croatia has jurisdiction, and Croatian law applies.
